Guardianship, Probate & Will RecordsFor those who may not know what these are, they are records of what was done with a person's property, usually land, after they died. If a person died with some amount of property, you will usually find some record of them in Probate. Even if the person owned very little, there may be at least the filing of a petition stating there was so little that no administration was needed. Some things that you may find include inventories of property they owned, how it was divided up, and the names of heirs. Guardianship was filed if the deceased left minor children; and a guardian was appointed for the child or children till they reached majority. Wills, of course, contain the person's own directions for dividing up their estate and usually name their children, spouse, and, sometimes, even grandchildren. You may also find petitions filed to prove a death so that a widow could collect her husband's pension. Not all records contain the same things. Some may not mention the date of the person's death, but others will. Usually, though, you will get at least an approximate date of death. The earliest records are for about 1823 The court jurisdiction responsible for probate changed a half dozen times in Indiana's history before finally settling in the county's circuit court. Thankfully, location of the records has remained with the clerk of the circuit court, although they are often stored in the county clerk's office. The records include wills, probate records, administration of estates, letters of administration, inventories of decedent's personal property, final record books, adoption papers, guardianship records, civil court records, records of minors, records of the insane, and naturalization records and proceedings.
