Zachariah listed his profession as cordwainer. He moved from Kittery to Chelmsford, Ma. by 1711, the year he was twenty-one, and remained there the rest of his life. In 1719 he was one of a group given liberty to build a stable near the meeting house. In 1725 he served in the militia company of Captain Joseph Blanchard of Dunstable, Ma./NH., as a sentinel, receiving 28/-per week pay. He was a selectman of Chelmsford in 1727-8.

On 26 Jan. 1744/5, by a majority of one, the Massachusetts General Court voted approval of Governor William Shirley's plan to attack and lay siege to the French Fortress of Louisburg on Cape Breton Island, now part of Nova Scotia. The fortress had been established by Louis XIV in the 1600's as a stronghold to protect the mouth of the St. Lawrence and hence to keep French control over traffic moving to the inland ports of the St. Lawrence, the Great Lakes, and beyond. The expedition against it fired the imagination of New Englander's, both as an adventure and as a crusade against the French, a secular enemy responsible for many excursions against their towns, and representatives of the hated Roman Catholic Church. It seemed an appropriate secular concomitant to the enthusiastic religious revival which had occupied much of New England's energy in the previous few years. 4300 New England men, 3250 from Massachusetts including Maine, set out at the end of March 1745, the largest military operation yet mounted by the New England colonies as a group on 30 April, having been joined by a naval force from England, they arrived at Louisburg and commenced a 46 day artillery siege. In June the fort was taken and the Catholic Chapel was stripped of its images and transformed into a Protestant church for a service of Thanksgiving. New England ecstatically celebrated the victory of Protestantism over poverty, as well as the success of a military operation almost entirely of its own making.

Zachariah Emery described his service in the Louisburg expedition in the following petition:

"t His Honou Spencer Phips Esq &c --- The Petition of Zachariah Emmery of Chelmsford in the County of Middlesex Himbly Sheweth -- That he in the month of June A.D. 1745 inlisted into His Majesty's Service in tyhe Expedition against Cape Breton under the Command of Gershom Davis, Captain & that he proceeded thither, & that in the month of October then next following; the General having given Orders for Each Company to choose an Agent to send to Boston, in new England, to make up the Muster-Roll of Each Company, he was then made choice of by the said Davis's Company for the same service and accordingly proceeded to Boston aforsaid & Effested the same Business: & that he was to have returned again to Cape Breton, but was prevented by the Providence of God, being taken sick and continuing so for a long time; that when he left Cape Breton, he left his Gun with & under the care of his son Samuel Emmery who was in the same service under the command of Captain Peter Hunt & that the said son afterward died at Cape Breton, aforsaid, and that the said Petitioners own Gun and his sons Gun were sent in a Chest with other Guns to Zeuber Bukler Commisaru to Briggadr. Dwights Regiment to his Agenht or Attorney Mr. Jarvis of Boston merchant to be delivered to the owners, but it happened through mistake that the said Chest of Guns was delivered by the said Mr. Jarvis to Mr. Wheelwright Commisary General of said Provincce whereby the said Petitioner hath been Prevented receiving his owne Gun & the Gin of his son aforsaide, as he ought to have done, they being his & his son's own property. Your Pertitioner therefore humbly prays you Honour & Honours would be pleased to make an order that he may be allowed out of the publick Treasury of this Province inconsideration of the loss of his own Gun, the sum of ten pounds ten schillings Old Tenor Bills and of his Sons Gun the sum of fifteen pounds Old Tenor Bills being the true value of the said Guns and your Petitioner as in duty bound shall ever pray, &ca. Zachariah Emery"

He was allowed L- -18/- for the guns, rather less than he had asked for; it is probably not unfair to suspect that the guns were not worth the L- -10/- he asked and that indeed he did not expect to collect that much. In looking at the tale of his service, one might also note that it was indeed providential, as he states, that he was back in New England when he took sick, illness proved to be a more treacherous enemy to the occupying forces that the French had been.

The Peace of Aix-la_Chapelle in 1748 temporarily restored order between the French and English, at the cost to England of returning Louisburg to France, to the great disgust of the colonists who had fought so hard to win it. Hostilities resumed in 1755-6, and on 26 Jul. 1758 the English under Lord Jeffery Amherst recaptured Louisburg for good.

Meanwhile, life in Chelmsford went on sort of peaceful. On 30 Oct. 1748, "Zach. Emery did boisterously Interrupt the Rev. Mr. Sawn when preaching and Charged him in a bold and daring manner with preaching falsely." He afterwards made confession of his fault before the whole congregation and asked forgiveness, which is probably more than his great-grandfather would have done. The episode might have had something to do with the Old Light-New Light controversy then raging. Zachariah was a delegate to the ordination of John Rand as minister at Lyndeborough on 7 Dec. 1757. Rand later converted to Anglicanism.

Zachariah Emery appears on a tax list for the south end of Chelmsford in 1775.

His gravestone and that of his third wife Thankful -- called Thankful Emery in spite of her subsequent marriage -- are located in the village cemetery behind the church in the center of Chelmsford. The carving is of excellent quality and preservation. Zachariah and Thankful Emery are buried in the historical section at graves 30 and 29 of the Forefather's Burying Ground at Chelmsford, Middlesex, Massachusetts.

He was bred to the trade of a cooper, but was admitted to the bar by taking the required oath. In a certain deed of record he styles himself "a practitioner in the courts". He thus attained the distinction of being, says Willis, "the first lawyer who ever resided in the state of Me." His great grandson Nickolas, grandson of Noah of Exeter, it maybe added in passing, became one of the Justices of the Supreme Court in the same state. The subsequent career of Noah proved that he had not mistaken his calling. The writer already cited characterized him as a lawyer "possessed of much legal acumen and accuracy; a ready draftsman, of quick perceptions and considerable ability, which gave him an extensive practice. He was repeatedly commissioned as "King's attorney" for the province of Me., Attorney General of the State, as he would now be described. A man of bookish tastes, he had an interest in the Portsmouth Social Library and also had a library of his own. To his sons he bequeathed his "books of law, physic, divinity, and history." One of these old law books was a copy of the earliest extant edition of the Laws of the Colony of Massachusetts, the edition of 1660. It now belongs to the Ma. Sate Library where it is carefully kept under lock and key, being "worth its weight in gold", says the librarian, since there are only two or three others in existence. His autograph and the date of its purchase are on the title page. Mr. Emery was also a military man of local consequences, being captain of the "Upper foot" company, in Kittery, in which there were nine other Emery's including the ensign. This office brought him into personal relations with Sir William Pepperrell then in chief command of the military forces of the state. A note from Sir William directing Captain Emery to have a detail of his command at Boston by a certain time discloses this fact. He d. 19 Dec. 1761.

He was a man of plain manners, of strict integrity, of peaceful character, discouraging litigation among his neighbors, even after he had entered the legal profession. He had the confidence of all with whom he came in contact, and was highly esteemed by his relatives and clients.

In 1766 or 67 Joshua Emery separated from the Congregational Church in Berwick, York, Me. and was called a "New Light". Through his influence, Elder (afterwards doctor) Hezekiah Smith of Haverhill, Essex, Ma. came to Berwick and presented the Baptist cause which resulted in the organization of the First Baptist Church of Berwick, 28 Jun. 1768, the first of that denomination in Me. Mr. Emery's name stands first on the list of seventeen original members and his wife Adah, the first of the six female members. He was elected elder at the first church meeting. He was never ordained but preached most of the time in this church till his death. He built a fourth part of the meeting house and gave it to the church, and a parsonage also. In thought he was independent with his brethren but in the end he generally had the best of it. He d. Feb. 1797.
